§ 1 Scope

(1) These General Terms and Conditions (GTC) apply to all contracts concluded via the online store at muuah.de between CKN GmbH, Heilbronner Str. 4, 75447 Sternenfels, Deutschland, represented by its Managing Director Mert Coskun, registered in the commercial register of the Amtsgericht Mannheim under HRB 748723 (hereinafter “we” or “seller”), and its customers (hereinafter “you” or “customer”). The store is operated under the brand muah.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent profession (§ 13 BGB). An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or independent profession (§ 14 BGB).

(3) Deviating terms of the customer do not become part of the contract unless we expressly agree to their validity.

(4) We deliver exclusively to delivery addresses in Germany.

§ 2 Conclusion of the contract

(1) The presentation of the products in the online store does not constitute a legally binding offer but an invitation to place an order.

(2) You can add products to the cart and then order them via checkout. At checkout, you enter your contact and delivery details and choose a payment method. Before you submit the order, the selected products, the total price including shipping costs and your details are displayed to you. Up to that point, you can identify and correct input errors using the editing functions at checkout, in the cart or via the back function of your browser.

(3) By clicking the button to place an order with obligation to pay (e.g. “Buy now”), you submit a binding offer to purchase the goods contained in the cart.

(4) We confirm receipt of your order by email immediately afterwards. With this order confirmation, we accept your offer; the purchase contract is thereby concluded. Should the order confirmation exceptionally not be sent immediately, the contract is concluded at the latest upon dispatch of the goods.

(5) The language of the contract is German.

§ 3 Storage of the contract text

We store the contract text (your order data). We send you the order data, these GTC and the withdrawal policy by email.

You can also view and print the GTC at any time at muuah.de/pages/agb. If you have created a customer account, you can view your past orders there.

§ 4 Prices and shipping costs

(1) All prices are final prices in euros and include statutory VAT.

(2) Shipping costs are charged in addition to the prices unless stated otherwise. Shipping within Germany costs €4.90 per order. For orders of €49.90 or more, we deliver free of shipping costs. The value of the goods after deduction of any discounts is decisive for free shipping. The shipping costs are clearly displayed to you in the cart and at checkout before you place your order.

§ 5 Delivery

(1) Delivery is made by DHL to the delivery address in Germany that you provide.

(2) We usually ship the goods within 1 to 2 business days after conclusion of the contract. Delivery by DHL usually takes place within 1 to 3 business days after handover to DHL. We state deviating delivery times on the respective product page.

(3) If an ordered product is unexpectedly unavailable, we will inform you without undue delay. We will refund without undue delay any payments already made for products that cannot be delivered.

(4) If the customer is a consumer, the risk of accidental loss and accidental deterioration of the goods only passes to the customer upon handover. If the customer is an entrepreneur, the risk passes upon handover of the goods to the transport company.

§ 6 Payment

(1) Payment is processed via the checkout of our store system Shopify. The payment methods offered to you at checkout apply. Depending on availability, these include in particular credit and debit card, Apple Pay, Google Pay and Shop Pay (via Shopify Payments), PayPal and Klarna.

(2) The purchase price is due upon conclusion of the contract. When paying by card, Apple Pay, Google Pay, Shop Pay or PayPal, the amount is authorized and charged when the order is completed. When paying via Klarna, Klarna's terms, which you will be informed of during the payment process, apply additionally.

(3) The terms of use of the respective payment service provider additionally apply to payment processing.

§ 7 Retention of title

The delivered goods remain our property until the purchase price has been paid in full.

§ 8 Discounts, volume discount and vouchers

(1) When you put together your own box using our Box Builder, we grant a volume discount according to the tiers shown there and in the cart. The discount is calculated automatically and shown in the cart and at checkout before you place your order.

(2) Promotional vouchers and discount codes can only be redeemed within the specified period and only once per order. They cannot be combined with other discount codes, promotions or the volume discount unless this is expressly stated. They cannot be redeemed for cash.

(3) If you withdraw from only part of a discounted order, we will refund the amount you actually paid for the returned goods, i.e. the proportionately discounted price.

§ 9 Right of withdrawal

Consumers have a statutory right of withdrawal. You can find details in our withdrawal policy. You can also declare your withdrawal electronically using the Withdraw from contract function.

§ 10 Warranty

(1) The statutory rights regarding defects apply.

(2) Please check the goods for obvious transport damage upon receipt and inform us of any such damage as promptly as possible. Your statutory claims remain unaffected; failure to comply with this request has no effect on the warranty rights of consumers.

(3) If the customer is a merchant, the inspection and notification obligations pursuant to § 377 HGB apply.

§ 11 Liability

(1) We are liable without limitation in cases of intent and gross negligence, for injury to life, body or health, under the Product Liability Act (Produkthaftungsgesetz), in cases of fraudulent concealment of a defect and to the extent of any guarantee we have assumed.

(2) In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the damage that was foreseeable and typical for the contract at the time the contract was concluded. Essential contractual obligations are obligations whose fulfillment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely.

(3) Otherwise, liability for slightly negligent breaches of duty is excluded.

(4) The above limitations of liability also apply in favor of our legal representatives and vicarious agents.

§ 12 Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 13 Applicable law and place of jurisdiction

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is our registered office.

(3) Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
